What did the driver have to say? Fourtnely ived been in only one small, small acicdent. The guy ended up paying for a new paint job of my bumper. But i have had a lady w/a suv run me off the road. I swear every person i have to honk my horn and or dodge is a female.

As far as a lawsuit... I'm considering it. I'm about to go to the ER to get checked out, since my doctor is out for the day already. Everyone already knows my seatbelt was off. Besides, if I do go through with it, I don't want to fudge anything. Frivolous or embellished lawsuits aren't something I could partake in. If me having my seatbelt off was partly responsible for an injury, that's just how it'll go. I got an initial estimate today. The body damage along is $6k. If there is any structural damage, that'll easily double. The part that REALLY pisses me off is what this'll do to the resale value.

Not sure what his seat belt has to do with anything. I know of several cases who won law suits when their belts were off.
My friend actually had to pay up for medical fees fot hitting somebody in his neighborhood (snow was out) the other guy was speeding but my friend lossed control. None of them had their seat belt on and one of them hit the windshield. Friend was found responcible and had to pay.

Uhh mike, it's a little illegal in california, and has been for years? Like someone else says, they can easily say he was being negligent and should have to pay his own medical fees and wouldn't have gotten slammed forward and pinched a nerve if he had his seltbelt on (this is probably true)
And we've all heard of criminals sueing after they break their leg while breaking into a house, stealing stuff, and win. But it usually doesn't happen; and if he wasn't wearing his seat belt, he's at a huge disadvantage already

Rev, yeah don't make anything up. But DO get even, legally of course. Do what shidarin says and sue for the resale value. I'm still thinking about the national "Watch your SUe-V" campaign I suggested.

The campaign is to WARN SUV drivers that if they handle their tanks negligently and cause damage to other people's property and harm the health of another, they will be sued. You call that no reason? Ok, you can obviously already see there is a reason, but I will still address your question of "legal fees." Haven't you heard of lawyers getting paid on a contingency basis for those seeking justice or haven't you heard of Prepaid Legal for those that need defense, or haven't you heard of regular car liability or collision insurance which pays for legal fees? Sure you have. I am in no way suggesting frivolous lawsuits. I am seeking to warn SUV drivers of the legitimate ones they will face if they harm other people.

FUCK SUVs. especially those SUVs driven by women. dont drive a huge ass car if you dont drive well. a bitch backed into my front bumper while she was trying to get out of the parking lane. i saw all of this while i was walking down the street to my car. the bad thing is i didnt know my car was behind her SUV, and she just took off. i am gonna fucking slap her if i ever see her again around the campus. i know man... lately ive been gettin a lot of dents on my doors... those freakin parkin spaces are super small.. and then some people dont have respect for someone elses car

mini update Got an estimate yesterday. They THINK the frame is okay, but they aren't sure until the pull the wrecked body parts off. If it's just body damage, they quoted me $6k. I'll talk to the adjuster today and get my car into the shop this afternoon (I hope). More importantly I talked to my Dad last night about what we're doing with the car. He agrees that we should sell it ASAP once it's fixed. Sooo... I'm going to put it up for sale private party when I get it back, and start looking at a manual (yay finally!) Celi with less miles (maybe new?) or a lightly used S2k.
