K guys... So my girlfriend was going towards the freeway...

The entire street in her neighborhood is under construction so traffic is like tail-to-tail...

She was reaching for her pup and accidently let go of the brake pedal... so she was going like 1/2-1 mph... Then rear ended this old lady...

Her son got out of the car and got my girlfriend's driver's license info and insurance... But the old lady didn't let my girlfriend have a chance to get the old lady's information...

My girlfriend kept gettng out of the car to ask for it but the lady said "it's not my fault so you don't need my information for anything... I know there's no damage to the car but I have back pains"

My girlfriend kept following, even on the freeway, but the old lady exited the freeway and now my girlfriend only has that lady's license plate number and nothing else...

SO WHAT'S GONNA HAPPEN?????

WHAT SHOULD MY GIRLFRIEND DO??? CALL THE COPS????

i dont know much about accidents, but did you say she was only going like 1 mph when she hit the old lady's car??

how the hell is that going to give her back pains? its not. the old lady is a liar and more than likely she probably wont persue the 'accident'. but tell your gf to keep the license plate number just incase.

what did you mean she was reaching for her "pup"?

EDIT: and im sure that your gf didnt do any damage to the lady's car, especially if she was going that slow.

Was there any damage at all to the two cars?

I dont know what the laws are in your state, but in Michigan if there is absolutly no damage to both cars, then by law no accident took place even if there was contact between the two cars. So in Michigan, the old lady couldn't sue for back pain as a result of the accident even if she wanted to.

If the cops weren't called to make a report on the accident in the first place and since there is no damage, don't do a damn thing. IMHO, I would just say that the whole thing never happened. If they say that they have your information and everything, just say you lost your insurance card. The rest of the info like your name and phone number and all of that good shit can be acquired from just getting someone's insurance card and running their name. If the cops weren't called then she has no grounds to sue you or claim anything from your insurance company, because only her and her son knew that there was an accident. From what you said, there was no damage.

That's what I think, and that's what I would do. Happened to me a while ago. Guy got my info and it was all my fault but no cops were called and there was no visible damage at all! He kept calling me, he called my insurance company, so I got a lawyer and told him that the next time he called me I was gonna press charges against him. He knew he didn't have a case cause you can't prove that the accident happened unless it was caught on camera or a police report was filed. I mean come on, there was no damage and this dickhead was complaining that he was hurt. He was driving like a 80 something Yugo and the guy was a total dirtball hoosier. I hate people that are always looking to get something for nothing.
If your GF was going as slow as she says she was, and there was no damage, I wouldn't worry about it. They have no grounds for a case unless you admit to something. It may seem like you have to act crooked and lie a little bit, but come on...that old lady isn't hurt. You would get more whiplash from accelerating than you would from being rear ended going a mile an hour. Unless your girlfriend was driving a semi or something. wink

Just play stupid and deny the whole thing. They can't prove a damn thing! If push comes to shove, the old lady will get one of those 421-HURT lawyers that you say on t.v. Those people are jokes. I work for a law firm, and we have one of those types of firms in the building on the same floor, and whenever we see stupid hoosiers get off the elevator, we know where they are going. rofl

Sorry to be a post whore, but don't call the cops unless you are repeatedly harassed by the old lady or her son. Even then I wouldn't call the cops, but rather I would consult with an attorney. But the latter isn't always cost feisable, and may not even be necessary in this case. Just play stupid.

i would call the cops so they could write up a police report that you may need in the future...depending on what that old bitch decides what to do.

tell you the truth. california law, someone can get in a bad accident and not have back pains, and later develop back pains. ive been in an accident, and i went to chiropracter. on the paper it has everything like from back pain to fright or not being able to sleep. IMO that lady can do something if she wants. cause she could say that she has severe back problems already and that little hit could have done something. in that instant, she didnt feel any difference but she got the information just in case if something happens. thats the law, but i dont know if it applies for 1/2mile, cz thats ridiculously nothing. you should have gotten a little more info about her maybe, i dont know that exactly. but if you ever go to court for it or something, you can refer to the 1/2 mile hit as a brake reaction. meaning if someone brakes usually a little hard or normal the car shakes, know wut i mean? you cant stop the car perfectly most of the time, theres a little shake. you can refer ur hit as that motion or maybe less. i mean seriously, htting 1/2 mile someone is a motion like someone pushes ur car on park, just shakes a little. good luck g2g

But then again, if the police were called, she might have had to pay medical bills/pain and suffering. How do they have proof that you did, no cops were called? Because they have your information? "Well I lost my insurance card a while ago, someone must have found it and is trying to take advantage of me."

As far as I'm concerned, the old lady probably shouldn't be driving in the first place. I hate old people, and if I ever get old then I accidentally lived too long. happywink

Not according to the old lady. "Well she never asked me for my information, I just got hers. She seemed to be in quite a hurry." She can make up any bullshit she wants. Also, if the old lady never gave her information, then the girl should have called the cops. The old lady is not accountable for not giving her information anyways, because the cops should have been called in the first place, and if you are in an accident, you are not required to give information anyways. That's what cops are for. They take both parties information, and file a report. The party not at fault is then given a copy of the report and calls to the insurance company are made. I'm sure that the party at fault can obtain a copy of the report for his/her insurance company, but they don't really care.

And you're right, calling the cops is free, but after you do so, the accident DID exist, and she can be held liable. Right now, the old lady is relying on the girl to tell the truth and admit that she is at fault and that the accident did happen. Right now that's all she has as proof.

i would do that if i were u. first after the oath thing, no need to lie cz you didnt really do anything big. second, if you say that ur friends have spare keys thats breaking the law already bro. how can he drive if he is not insured under the car. i mean the way ur saying it is wrong. a friend could borrow a car and drive sometimes but ur saying a lot of my friends have spare keys. how did the old lady talk? was she rude or was she just asking information? it doesnt really sound that she was mean since she said im sure nothing hapened to the car but just in case i get bad. by looking at it another way its bad, meaning she has a back pain already and blaming the accident and you shell get free therapy eventhough she probably is getting cz shes a senior citizen. if i were u, i would find out her phone number and talk to her personally. goto dmv and find out her # or else you have to buy her information. it would be nicer to call her personally and ask her how she feels, say sorry, and then ask her if shes doing anything against u. IF she takes you to court, like a said just say that the impact was avery light, lighter than a brake reaction movement. thats the best way to go, i mean someone has to be fucked up to get worst at a 1/2miles accident. btw if somene has a sever injury like that they shouldnt drive. another thing, DONT WORRY at all, cause its nothing really big. if it were bigger, the cops would have been called. now that there is no police evidence, case is dismissed way easier
