SORRY SO LONG, I'M JUST TOTALY PISSED!!!

I parked my car 2002 GTS under the neon sign where the night lights are shining down bright. A sHift change just took place at Waffle House. I was studying for a test in Western Civ II. At 6:30am this waitress gets a lift home. I look out as she backs up, and back and back, you know? My car is back there|..I sure hope she! She doesnt. She knocks my car 18 inches to the side. The center of her bumper hit the corner of my bumper. The foam and scratches in the paint are the only visible damage.

She tells me she is not supposta be driving and informs me that she has no insurance. She had the audacity to ask me if I would not call the police. She doesnt know Im a prior Deputy Sheriff! I call in to dispatch and give the tag info off her car. Then they ran the owner. She had a warrant out on her! She was ticketed for no insurance, and the best part is that I filled out the incident report and made the diagrams!!!

1. I have uninsured motorist on my policy. If I use it will it make my rates go up?
2. Do I register mail her certified copies of estaments, then sue her? Or use insurance?

My sister got rearended 2 weeks ago... same story! the chick that hit her had no insurance! Why do the laws not require that the car in such cases be impounded untill proof is given to the judge? both times the cars just drove off... WITHOUT INSURANCE!!!!!!

Dude you have to try to get her to pay for the damage in cash since she has no insurance. Was it really bad? If not just charge her a couple hundred & tell her that U won't file a claim. Be a nice guy...it works most of the time.(make sure you have all her info though)

[/quote]I guess the uninsured driver will get a citation for no insurance & will need to provide proof of insurance in court. U can also sue for damages.

that sucks in Ca. it's the law.. you have to be insured

in CA, in some town there are more than 60% that are uninsured.

If I file, what will keep My insurance from going up? It will be hard for me to get a free day to goto court, but I will. I'm a full time student and DAD/Husband & I work 80 MI away at a airport weekend nights. Her having no Insurance makes me upset, way more than hitting me!

There are scratches on my bumper, but the foam inside it is toast. I need enough for a new painted bumper Assy. from her![list]
